Helpful Links for Mitigating the Risk of Title Fraud

There is a way to help protect yourself from home title hackers. Several metro Denver Counties offer a free service if you register. This service notifies you via email if your name comes up to record a deed. The catch is, that you need to sign up with your name and any variations of your name, so they can email you.

Why is this important? Sometimes bad people do bad things. In my career, I’ve had several instances where unbeknownst to me or others involved someone poised as a person they weren’t.

Once a seller brought his girlfriend to sign instead of his wife. His deception was not uncovered until a month or so later I got a call from his wife asking about where her closing funds were! I was the selling agent for the buyer of the house. Luckily, my client had Title Insurance. I think the hubby did a little time behind bars!

Another time I received a call from a lady who had “inherited” a house. That was a lie, she had deceived the court (successfully) and was assigned as the executor to sell the property. It was a weird experience for me because when I told her how much the home should sell for, she wanted it to sell “quickly” and asked that I reduce the price by $100,000! (That’s not a typo!) Of course, no seller ever said that to me, and when she said it the hairs on the back of my neck went up. I knew something was out of place. A few days later when the title company required a copy of the will and other documents, she demanded that I sell the property without Title Insurance.

LOL

No.

The next day I was able to locate the actual TRUE executor in Texas. Whew!

Last I heard the law was looking for the lady who was a fraud.

There’s much more to these stories, but you get the drift.

It’s up to you to protect yourself as best you can. There are so many people out there who would rather spend their time figuring out creative ways to defraud someone than doing useful work.

Back to my original message, the following counties in Metro Denver have created a way for you to be notified if anyone is trying to use your name to record a change in property. It’s easy, so go sign up!

Jefferson and Larimer Counties DO NOT currently have an automatic notification service.

El Paso County states the following on its website (no sign-up required):
“The property owner will be notified when the exact name on public records is listed as a Grantor or Grantee. This will provide an early warning system that allows the property owner to take action if they believe fraudulent activity has occurred with their property.
FYI if you own LAND, don’t forget to contact the county where it is to see if you can get these same notifications. I’ve been advised the Land Scams are the #2 fraud after Wire Fraud Scams. Do the bad guys ever rest?

Denver Real Estate Inventory

According to September statistics released by the National Association of REALTOR, the nation is still in a seller’s market, meaning we have less than six months of housing inventory available at the present sales rate. Looking at the Denver area market, the current rate of sales versus inventory indicates we have 2.6 months of inventory at the present rate of sales, well below the traditional definition of a neutral market of 6 months of available inventory. While rising interest rates have slowed the market, the market is a long way from stopping.

Comparison of Residential Construction

This is a national look at monthly new residential construction, broken down into the four stages of construction. Building permits and housing starts are the leading indicators that tell us where the market is headed. On the bottom, under construction and housing units completed are the lagging indicators of what’s happened so far. The leading indicators, the two at the top, permits, and starts are slowing down from May to June. Builders are concerned and very gun shy of rising mortgage rates. Builders are not going to overbuild. We’re not going to get started on more homes than we know we can complete. They’re being cautious right now, so while we’ve had 14 years of undersupply of newly constructed homes built in this country, they’re not going to overbuild at this time.

Real Estate Sales Breakdown

There has been a pickup in the inventory that we’ve seen recently, but it’s not from a big increase in new listings … but rather a slowdown in the pace of sales. And remember that a month’s supply measures the inventory relative to the sales pace. Same inventory, fewer sales, means more months’ supply.

Real Estate Market Adjusting

As the market begins to show an increase in available inventory, it’s important for everyone to recognize that in a “normal” market, houses sell because they are: 

Priced right.

Meaning comparable sales need to be 60 days or less, preferably 30, & sellers cannot “reach” thinking they can squeeze another $10,000 out of the large pool of buyers. The buyer pool is very nervous, & with interest rates exceeding 6%, consumers will need time to adjust to the rapidly increasing mortgage rates. 

Showplace Pretty

Home sellers must prepare their homes to look better than the competition, & accede to at least some of the buyers’ demands after inspection.

The overall market will be fine, as there are more buyers than sellers, but how we prepare our clients for the buy or sell must include a discussion of expectations.

Metro Denver Industrial Construction

With much of the recent Industrial Construction occurring in Adams County, residential areas on Metro Denver’s far east side and the I-76 corridor are progressing at a rapid rate. Water supplies secured by Aurora support large-scale developments such as Painted Prairie, Aurora Highlands, and Sky Ranch. With close proximity to Denver’s International Airport and the E-470 Toll road, residents in those areas can expect to see property values continue to appreciate at a steady, if not aggressive rate as the housing economy adjusts from the pandemic years.
